Copyright & DMCA Policy

We respect the intellectual property rights of others and expect users of the CATNA Library to do the same. This policy describes how to notify us of claimed copyright infringement and explains our process under the U.S. Digital Millennium Copyright Act (the “DMCA”) and comparable UK and EU regimes.

1Overview

1.1 Scope.This policy applies to any material exposed through the Library that is alleged to infringe the copyright of a third party.

1.2 Good-faith investigation.We review properly submitted notices promptly and in good faith. We may remove or disable access to allegedly infringing material pending our review.

2Designated Agent

2.2 Only-accepted channel.Notices sent to any other address, DM, or platform may not be processed. Use the email above.

3Filing a Notice

3.1 Required contents.To be effective, a notice of claimed infringement must be in writing and include all of the following:

  • a physical or electronic signature of the owner (or a person authorised to act on the owner’s behalf) of the allegedly infringed right;
  • identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works);
  • identification of the material claimed to be infringing, with enough detail (URL, SOP title, or screenshot reference) to allow us to locate it in the Library;
  • your contact information, including full legal name, postal address, telephone number, and email address;
  • a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
  • a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner’s behalf.

3.2 Action on valid notice.On receipt of a valid notice we will acknowledge receipt, review the claim, and, where appropriate, remove or disable access to the material. We may also notify the affected account holder.

4Counter-Notice

4.1 When to file.If material you posted was removed in reliance on a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a counter-notice to legal@catna.cc.

4.2 Required contents.A valid counter-notice must include:

  • your physical or electronic signature;
  • identification of the material removed and its location before removal;
  • a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  • your name, postal address, telephone number, and a statement that you consent to the jurisdiction of the courts of England and Wales, and (if you are located in the United States) the Federal District Court for the judicial district in which you reside, and that you will accept service of process from the claimant or the claimant’s agent.

4.3 Action on counter-notice.On receipt of a valid counter-notice we may forward it to the original claimant and, unless we receive notice that the claimant has filed a lawsuit, restore the material after an appropriate waiting period as permitted by applicable law.

5Repeat-Infringer Policy

We maintain a policy of terminating, in appropriate circumstances, the Access of users whom we determine, in our reasonable discretion, to be repeat infringers. A termination under this policy is without refund and is in addition to any remedy we have under the Terms of Use, the EULA, or the CATNA 2.0 Terms of Service.

6Misuse of Notices

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages. We reserve the right to recover damages, fees, and costs from any person who submits a notice or counter-notice in bad faith.

7Our Own IP

Unrelated to third-party copyright claims, the Library itself and all Materials are our intellectual property or that of our licensors and are protected under the CATNA 2.0 EULA and the Library Terms of Use. This DMCA Policy does not authorise any use of our Materials that is not expressly permitted under those agreements.
